Acceptance of These Terms

These Terms of Use constitute an agreement between you and ContactHVAC concerning your access to and use of contacthvac.com and its content, forms, contractor-matching features and related services.

By accessing the website, submitting information or otherwise using ContactHVAC, you acknowledge that you have read, understood and agreed to these Terms and the Privacy Policy.

Additional notices or terms displayed in connection with a particular form, feature or service are incorporated into these Terms for that interaction.

Eligibility and Authority

You must be at least 18 years old and legally capable of entering into an agreement to submit an HVAC service request or use features intended to create a commercial connection.

By submitting information about a property, you represent that you are authorized to request service for that property or have permission from the owner, manager or other responsible party.

If you use ContactHVAC on behalf of a business, organization, landlord, property manager or another person, you represent that you have authority to bind that party to these Terms.

ContactHVAC’s Role

ContactHVAC operates an informational and contractor-matching platform. We may publish educational content, collect service-request information and help connect users with independent HVAC professionals.

Unless expressly stated in a separate written agreement, ContactHVAC is not:

• A party to agreements between users and contractors.
• An employer, partner, agent or representative of a contractor.
• An engineering, architectural or code-consulting provider.
• An insurer, warranty administrator or financing provider.
• An emergency dispatch or public-safety service.
• A guarantor of contractor availability, pricing or performance.

ContactHVAC may receive compensation for referrals, service opportunities, advertising, sponsored placements or other commercial relationships.

HVAC Service Requests

ContactHVAC may allow you to submit information about a heating, cooling, ventilation or related property need. Submitting a request asks ContactHVAC to use the provided information to identify or contact potentially relevant independent service providers.

You agree to provide accurate information

Information submitted through the website must be accurate, current and complete to the best of your knowledge. Do not impersonate another person, submit a request for a property without authorization or provide false information intended to mislead a contractor.

Requests may be shared

As explained in the Privacy Policy, service-request information may be disclosed to one or more independent contractors, service providers, referral networks or matching partners that may be able to respond.

Submitting a request does not guarantee:

• That a contractor will receive the request.
• That a contractor will contact you.
• That service is available in your location.
• That a contractor will accept the project.
• That an estimate or appointment will be provided.
• That requested work can be completed.
• That a quoted price will fall within any website range.

Telephone, Text and Email Communications

When you provide contact information, you authorize ContactHVAC to communicate with you for purposes related to your inquiry, website support or service request.

Depending on the consent language displayed on the form, you may also authorize one or more independent contractors or matching partners to contact you by telephone, email or text message regarding the requested HVAC service.

Message and data rates may apply to text messages. Communication frequency may vary according to the request and responses from participating providers.

Where supported, you may opt out of text communications by replying STOP. You may unsubscribe from promotional email using the link supplied in the message.

Independent Contractors and Service Providers

HVAC professionals introduced through ContactHVAC are independent businesses. They are not employees, agents, franchisees or representatives of ContactHVAC unless a separate written statement expressly provides otherwise.

Each independent contractor is solely responsible for:

• Determining whether to respond to a request.
• Verifying the property and diagnosing the equipment.
• Providing estimates and explaining proposed work.
• Setting prices, deposits and payment terms.
• Maintaining required registrations, licenses and insurance.
• Obtaining permits and arranging inspections when required.
• Performing work safely and in compliance with applicable law.
• Providing equipment, labor and warranty documents.
• Resolving complaints, callbacks, damages and disputes.
• Protecting information it receives from users.

ContactHVAC does not control a contractor’s personnel, schedule, communications, diagnosis, pricing, proposal, workmanship, materials, warranties or business practices.

Your Responsibility When Hiring a Contractor

You are responsible for evaluating and selecting any contractor you choose to contact or hire.

Before approving work, consider verifying:

• The contractor’s legal business name and contact information.
• Applicable trade licenses and registrations.
• Liability and workers’ compensation insurance.
• References, complaint history and relevant reviews.
• The diagnosis and reason the work is recommended.
• The exact equipment and model numbers proposed.
• The complete written scope and stated exclusions.
• Permit and inspection responsibility.
• Payment schedule, deposits and financing terms.
• Manufacturer and contractor labor warranties.
• Cleanup, removal and disposal responsibilities.
• Cancellation, change-order and dispute terms.

Massachusetts users should independently determine whether a contractor is required to hold Home Improvement Contractor registration or another trade credential for the proposed work.

Prices, Cost Ranges, Estimates and Incentives

Prices, cost ranges and project examples published by ContactHVAC are general informational estimates. They are not bids, offers, appraisals or guarantees.

Actual costs may vary based on equipment, property conditions, labor, location, access, permits, ductwork, electrical work, fuel systems, hazardous materials, seasonality and contractor pricing.

Only a written proposal from the contractor can describe the price and scope being offered for a particular project.

Rebates, financing and tax information

Information about rebates, financing, tax credits or energy programs is general and may change without notice. ContactHVAC does not determine eligibility, approve applications, provide tax advice or guarantee that a project will qualify.

Verify current terms directly with the responsible government agency, utility, lender, tax professional or program administrator before relying on an incentive.

Educational Content and No Professional Advice

ContactHVAC publishes general information about heating, cooling, ventilation, indoor comfort, maintenance, costs, equipment and contractor selection.

This content is not a substitute for:

• An in-person HVAC inspection or diagnostic test.
• Engineering or architectural advice.
• Electrical, plumbing or gas-fitting advice.
• Building-code or permit review.
• Legal, tax, insurance or financial advice.
• Manufacturer-specific service instructions.
• Emergency assistance.

Descriptions of symptoms or common causes cannot confirm the condition of your equipment. Several different failures may produce similar symptoms, and attempting unqualified repairs can create fire, electrical, combustion, refrigerant or carbon-monoxide hazards.

Although ContactHVAC seeks to provide useful information, we do not warrant that every page is complete, current, error-free or suitable for a particular property.

Emergency and Hazardous Situations

ContactHVAC is not an emergency service and should not be used to report or obtain assistance for an immediate threat to health, life or property.

ContactHVAC does not guarantee that forms or messages will be reviewed immediately. Do not submit emergency information through a general contact or contractor-request form.

User Submissions and Feedback

You may submit service-request details, messages, correction requests, feedback, photographs, documents or other materials where a website feature permits.

You retain any rights you hold in original materials you submit. You grant ContactHVAC a nonexclusive, worldwide, royalty-free license to host, store, reproduce, process and transmit those materials as reasonably necessary to:

• Operate the website.
• Respond to your message.
• Process or route an HVAC service request.
• Investigate abuse or security issues.
• Evaluate and improve ContactHVAC.
• Comply with legal obligations.

You represent that you have the right to submit the materials and that doing so does not violate another person’s privacy, intellectual-property or contractual rights.

Do not submit confidential business information, trade secrets, medical records, account passwords, payment-card numbers or unnecessary sensitive information.

• Impersonate another person, contractor or organization.
• Use the website to harass, threaten or deceive others.
• Upload malware or attempt to compromise website security.
• Interfere with website operation or another user’s access.
• Attempt to gain unauthorized access to systems or records.
• Scrape, harvest or collect personal information without permission.
• Use automated tools in a manner that creates unreasonable load.
• Copy or republish substantial website content without authorization.
• Circumvent technological or access restrictions.
• Use ContactHVAC to violate applicable law or third-party rights.

ContactHVAC may block access, remove submissions or cooperate with authorities when we reasonably believe the website is being misused.

Intellectual Property

The ContactHVAC name, branding, website design, original text, graphics, organization, software and other original materials are owned by or licensed to ContactHVAC and are protected by applicable intellectual-property laws.

Subject to these Terms, ContactHVAC grants you a limited, revocable, nonexclusive and nontransferable right to access and use the website for personal, lawful purposes.

You may not reproduce, modify, distribute, sell, sublicense, claim ownership of or create a competing database from ContactHVAC content without prior written permission, except where applicable law expressly permits the use.

Third-party names, logos, product names and trademarks belong to their respective owners. Their appearance does not necessarily imply endorsement, sponsorship or affiliation.

Third-Party Websites, Products and Services

ContactHVAC may link to or integrate with contractors, government agencies, utilities, manufacturers, form providers, analytics services, financing providers and other third parties.

ContactHVAC does not control and is not responsible for third-party websites, availability, content, security, privacy practices, products or services.

Your interactions with a third party are governed by that party’s own terms, policies and agreements. Review the applicable documents before submitting information or entering into a transaction.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CONTACTHVAC AND ALL CONTENT, FORMS, MATCHING FEATURES, LINKS AND RELATED SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

CONTACTHVAC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY AND RESULTS.

CONTACTHVAC DOES NOT WARRANT THAT:

• The website will always be available or error-free.
• Information will be complete, accurate or current.
• A contractor will respond or accept a project.
• A contractor is qualified for every type of work.
• Any quote, diagnosis, repair or installation will be satisfactory.
• A project will comply with code or qualify for an incentive.
• Website use will prevent equipment failure or property damage.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES. IN THOSE JURISDICTIONS, THESE EXCLUSIONS APPLY ONLY TO THE EXTENT PERMITTED BY LAW.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CONTACTHVAC AND ITS OWNERS, AFFILIATES, SERVICE PROVIDERS, CONTRACTORS, LICENSORS AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES.

THIS INCLUDES LOSS OF PROFITS, LOSS OF DATA, LOSS OF USE, EQUIPMENT DAMAGE, PROPERTY DAMAGE, BUSINESS INTERRUPTION, REPLACEMENT COSTS OR DAMAGES ARISING FROM:

• Use of or inability to use ContactHVAC.
• Reliance on website content or cost information.
• A contractor’s communication, estimate or work.
• A decision to repair, replace or operate equipment.
• Unauthorized access to or alteration of information.
• Third-party websites, products or services.
• Delays, omissions, interruptions or website errors.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONTACTHVAC’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE WEBSITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS OR THE AMOUNT YOU PAID DIRECTLY TO CONTACTHVAC FOR THE RELEVANT WEBSITE SERVICE DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

These limitations do not apply where prohibited by law or to liability that cannot legally be limited.

Indemnification

To the extent permitted by law, you agree to defend, indemnify and hold harmless ContactHVAC and its owners, affiliates, service providers, licensors and representatives from claims, losses, liabilities, damages, judgments, costs and reasonable legal fees arising from:

• Your unlawful or unauthorized use of the website.
• Your violation of these Terms.
• False or misleading information you submit.
• Your violation of another person’s rights.
• Materials you submit through ContactHVAC.

This section does not require a consumer to indemnify ContactHVAC for conduct for which indemnification cannot lawfully be required.

Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules, except where another law must apply.

Before filing a claim against ContactHVAC, you agree to send a written description of the dispute through the Contact page and allow a reasonable opportunity to investigate and attempt an informal resolution.

Unless applicable law requires otherwise, legal actions relating to these Terms or ContactHVAC will be brought in a state or federal court with jurisdiction in Massachusetts.

Suspension and Termination

ContactHVAC may restrict, suspend or terminate access to all or part of the website when reasonably necessary to protect the website, users, contractors or third parties.

This may occur when we believe a user has violated these Terms, submitted fraudulent requests, threatened others, interfered with website operation or created legal or security risk.

Provisions that by their nature should continue after termination—including intellectual-property provisions, disclaimers, liability limitations, indemnification and dispute terms—will survive.

Changes to ContactHVAC and These Terms

ContactHVAC may modify, suspend, discontinue or add website features at any time.

We may update these Terms to reflect legal, operational, technical or business changes. The effective date at the top of the Terms will be revised when changes are made.

Material changes may also be communicated through a website notice or another appropriate method. Your continued use after revised Terms become effective constitutes acceptance of those revised Terms, except where applicable law requires another form of consent.

General Provisions

If a provision of these Terms is found unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain effective.

ContactHVAC’s failure to enforce a provision does not waive the right to enforce it later.

You may not transfer your rights or obligations under these Terms without ContactHVAC’s written consent. ContactHVAC may transfer these Terms in connection with a merger, acquisition, reorganization, sale of assets or other business transaction.

Headings and the plain-English summary are provided for convenience and do not limit the substantive Terms.

These Terms, the Privacy Policy and applicable form disclosures constitute the agreement between you and ContactHVAC regarding website use.
